When applying for a grant of probate, there are several steps you need to follow. Here’s how to go about it:
Submitting an Application
Before submitting your documents to the NSW Supreme Court, you must first provide a notification. This notification, available on their website, indicates your intention to administer the estate.
The process for applying for a grant of probate involves the following steps:
- Collecting supporting documents
- Publishing a probate notice
- Allowing 14 days
- Lodging a probate application
- Addressing court requisitions
The fee for applying for a grant of probate is based on the value of the estate’s assets. If you submit a probate application more than six months after the deceased’s date of death, you’ll need to provide the court with an explanation for the delay.

The process will take longer if the court documents are incomplete or unclear.
In such cases, the Supreme Court will request additional information and will only process the grant of probate once all required information is provided.
